SALES TERMS

1. SCOPE OF APPLICATION

The sales terms and conditions (hereinafter referred to as “STC”) apply to all orders and contracts concluded (hereinafter referred to as “order”) via the Wonderlust Emporium online shop (hereinafter referred to as “the provider”).

The provider reserves the right to change the terms and conditions. The version of the Sales Terms and Conditions applicable at the time of the order is decisive, which cannot be unilaterally changed for this order.

2. OFFER

The offer is aimed at customers residing worldwide. Deliveries are also made worldwide.

The offer is valid as long as it is visible in the online shop and / or stocks last. Price and range changes are possible at any time. The images shown in advertising, brochures, in the online shop, etc., as well as all information about the products are used for illustration purposes. Since the products are one-off handcrafted, slight deviations from the product actually received are possible. Furthermore, due to different monitor settings, slight deviations in the colors shown are possible. If products are shown in the shop with additional decorative elements (e.g. decorations, candles, trays, etc.), these decorative items are not included in the product price.

3. PRICES

The prices in the online shop are shown in CHF. The price does not include the costs for packaging and shipping. They are mentioned in the shopping cart / checkout and vary depending on the size and packaging of the product.

The price in the online shop at the time of the order is decisive.

4. ORDER

The presentation of the products in the online shop is not a legally binding application, but a non-binding online catalog or a non-binding invitation to the customer to order the product in the online shop.

An order is considered an offer to the provider to conclude a contract.

After submitting the order, the customer automatically receives a confirmation of receipt, which documents that the order has been received by the provider. Customers can only add or cancel the order until it is processed.

The provider is free to refuse orders in whole or in part, without giving reasons. In this case, the customer will be informed and any payments already made will be refunded. Further claims are excluded, in particular the non-deliverable products will not be forwarded. Products that cannot be delivered temporarily cannot be reserved.

5. CONCLUSION OF A CONTRACT

A contract is only concluded when the order is sent. As soon as the order has been placed for shipping, the customer receives an order confirmation by email, in which the tracking number is also given.

6. PAYMENT

6.1 PAYMENT VARIANTS
Payments must be made in Swiss Francs.

6.2 ELECTRONIC PAYMENT MEANS
Credit cards (Visa, Mastercard, American Express) via Shopify Payments and PayPal are accepted as payment methods. The debit takes place after receipt of the order.

6.3 PURCHASE BY TRANSFER IN ADVANCE
It is possible to pay in advance. For this purpose, the customer receives an invoice with the details of where the amount should be transferred. The processing of the order only begins with the receipt of the amount owed. If the invoice is not paid within 10 days of receipt of the order, the order will be canceled.

6.4 PURCHASE ON INVOICE
Existing customers can purchase on account. When purchasing on account with a payment slip by post, the customer will be sent the invoices including the payment slip with the goods sent. The invoice is payable within 14 days of receipt of the goods without any discount.

In the event of default, the provider reserves the right to charge reminder fees and default interest. All expenses incurred in connection with the collection of overdue claims are borne by the customer. In the event of unsuccessful reminders, the invoice amounts can be assigned to a company commissioned with the collection. The company entrusted with the collection will assert the outstanding amounts in its own name and for its own account and may charge additional processing fees and default interest from the due date.

6.5 VOUCHERS & DISCOUNTS
Vouchers from the provider are in no way for sale or auction. Only one voucher can be used per order. Vouchers and other discount codes cannot be cumulated, but vouchers also apply to products that are on offer or reduced in price due to special offers.

7. DELIVERY

7.1 DELIVERY AREA
The provider delivers worldwide.

7.2 SHIPPING TIMES
The shipping time depends on the customer’s place of residence. Goods are always sent by A-Post or Priority International via Swiss Post. The transit times, especially for foreign countries, also depend on factors such as customs clearance, etc., over which the provider has no influence.

7.3 DUTIES, TAXES & OTHER CHARGES
For customers outside of Switzerland, additional duties, taxes and fees may apply depending on the country. These are borne by the customer and are not included in the product price or shipping costs. The provider declares all goods properly in accordance with the applicable regulations (CN 22 for a goods value of up to CHF 400). A declaration with a lower value of goods or as a gift will not be carried out.

7.4 DELIVERY COSTS
The delivery costs depend on the weight and volume of the products ordered. The delivery costs specified in the online shop apply. The delivery costs are listed as an additional item in the shopping cart and on the order confirmation / invoice.

8. RETURN POLICY

8.1 REFUND POLICY
Under Swiss law there is no statutory right to return. However, as a gesture of goodwill, the provider grants a 14-day right of return on products that are not custom-made under the following conditions:

– The product must be returned to the supplier at the customer’s expense
– The product must be in undamaged, perfect condition and must not show any signs of use
– The return must be declared in writing / by email to the provider within 14 days of receipt of the goods
– The product must be returned within 30 days of receiving the goods

If all points are met, the provider reimburses the customer for the cost of the product minus a restocking fee of 20% of the product price in the same way as it was paid for. Shipping costs and all other costs such as taxes, duties and fees are non-refundable.

The provider reserves the right not to grant or revoke this right of return without further explanation in individual cases.

8.2 CUSTOM MADE
Products that are specifically designed and manufactured according to customer requirements specify as custom-made. The return of custom-made products is generally excluded.

10. INTELLECTUAL PROPERTY

10.1. RIGHTS OF WONDERLUSTEMPORIUM.CH
The provider retains all copyrights and other rights to the website as well as the content, information, images, videos and databases published by it on the website. Modification, duplication, publication, passing on to third parties and / or other use of the protected property without the prior written consent of Wonderlust Emporium is not permitted.

10.2. CUSTOMER RIGHTS
The customers retain all ownership rights to the content and comments posted on wonderlustemporium.ch. However, you do allow the provider to use these materials for promotional purposes free of charge.

11. LIMITATION OF LIABILITY

11.1. GENERAL
Unless expressly mentioned in these terms and conditions and legally permissible, all warranty claims against the provider are excluded.

The provider is only liable for direct damage caused by intentional or grossly negligent actions. Liability for direct damage in the event of slight negligence – regardless of the legal reason – is expressly excluded, subject to mandatory statutory provisions. Liability for indirect damage or consequential damage – for whatever legal reason – is fully and expressly excluded.

11.2. TECHNICAL MALFUNCTIONS, MAINTENANCE
The provider is not liable for the temporary unavailability, failure or malfunction of the website. In particular, the provider is not liable for technical problems due to which offers are not accepted or processed late, or incorrectly. Due to maintenance work or other reasons, the website may be temporarily unavailable or only available to a limited extent without the user having any claims against the provider.

11.3. USERS AND THIRD PARTIES
In particular, the provider is not liable for damage caused to users or third parties through the behavior of other users or third parties in connection with the use or misuse of the website.

The provider assumes no liability for the topicality, correctness, legality, completeness or quality of the content of websites that can be reached via links on wonderlustemporium.ch and excludes any liability in this context.

12. APPLICABLE LAW AND JURISDICTION
All disputes in connection with the present General Terms and Conditions are subject to Swiss law to the exclusion of the rules on international private law. The place of jurisdiction is Aarau, Switzerland.

13. SEVERABILITY CLAUSE
Should individual provisions of these terms and conditions be wholly or partially void and / or ineffective, the validity and / or effectiveness of the remaining provisions or parts of such provisions shall remain unaffected. The invalid and / or ineffective provisions will be replaced by those that come closest to the meaning and purpose of the invalid and / or ineffective provisions in a legally effective manner. The same applies to any gaps in the regulation.
